Terms of Use

The agreement entered into between Universal Web Services, MenuMundo and/or its subsidiaries, hereinafter referred to as ("MenuMundo") and you, the User (“User), who wish to use the described services below of MenuMundo in accordance with this Agreement and its various policies. MenuMundo and the User hereto agree to the following:

1. SERVICE DESCRIPTION: As an Internet Service Provider, MenuMundo provides content management, website hosting, ecommerce, domain registration, dns hosting, email hosting and support for all previously mentioned services. MenuMundo maintains a network of dedicated web hosting servers. These servers send and receive data in accordance with the MenuMundo Service Level Agreement.

2. CONDITIONS:

1. User may resell to third parties, but is responsible for third party support, training, content, development, billing and any other service provided by MenuMundo to User, and is bound by the terms of this Agreement.
2. The duration of this Agreement shall be as User has already selected on the MenuMundo order form.
3. Cancellations made after an order has been received by MenuMundo, and after web services or domain registration have been set up, do not nullify User responsibility to pay costs incurred by MenuMundo in setting up said services or domain registration.
4. User agrees not to de-compile or reverse-engineer any of MenuMundo’s Internet software.

3. WARRANTIES and LIMITATION OF LIABILITY: With respect to the Services mentioned in 1. SERVICE DESCRIPTION, User understands and acknowledges that:

1. MenuMundo makes no warranties express or implied.
   
2. User agrees that MenuMundo shall not be liable to User for any claims, damages, or loss of profit which are a direct result of the Services provided, including, but not limited to, losses or damages resulting from loss of data due to delays, non-deliveries, or Service interruptions, except where expressly noted in the Service Level Agreement.
3. MenuMundo specifically disclaims and denies any responsibility for the completeness, accuracy, or quality of data provided by User via the MenuMundo content management system.

4. CONFIDENTIALITY

1. User and MenuMundo hereby agree not to disclose or use, and to assure that their staff does not disclose or use, any confidential information belonging exclusively to one another. User and MenuMundo acknowledge that the following materials and information, and all copies thereof, constitute one another’s Confidential Information:
2. Lists of subscribers, Users, or clients, including information pertaining to their billing information, preferences or other data contained within any MenuMundo product or service.

5. CANCELLATION OF SERVICES: In the event that MenuMundo believes that services are being utilized for unlawful purposes by User, or in a way that does not conform to terms of this agreement, MenuMundo may immediately discontinue such services to User without liability.

6. INTEREST IN User'S DATA AND DOMAIN NAME: User agrees that MenuMundo shall have an interest in User’s data and in User’s Domain Name, and shall have the right in MenuMundo’s sole discretion to suspend, cancel, transfer, or modify User's hosting account and domain name in the event that User fails to pay or otherwise does not conform to this Agreement. User agrees that MenuMundo owns all rights to domain names procurred by MenuMundo in conjunction with any service plan or package.

7. CHANGE OR ADDITION TO TERMS: MenuMundo reserves the right to make changes to the terms of this Agreement at any time, as well as pricing of the any service or product offered, given advance notice to User via any or all methods of contact provided by User at the time of registration.
